c1707 An account of state of Old Malton School

The document briefly outlines the Foundation of the three Free Grammar Schools by Robert Holgate, and lists the lands which endow the School, and the rent values relating to them. These are Sutton Grange in Norton, Broomhills in Ryton, land and buildings in Ebbertston and Yedingham, and Old Malton. It says lands at Huggate "are now lost", makess the case that the rents do not provide the £20 per annum the Founder allocated as payment to the Schoolmaster, and criticises the previous schoolmaster, George Mill, schoolmaster from 1697 to 1707), for having allowed the lands and building to decline to "a very ruinous condition". (Incidentally this helps date the document - certainly after 1697, probably after Mill ceased to be schoolmaster.)

This early document is probably in the collection because it is referred to, and summarised, by William Pound in the 1840s, being used in justification for his in moving the school to Norton and widening its curriculum.

An account of state of Old Malton School

Robert Holgate alias Halgate, Archbp Archbishop of York by letters patents dated the 28th of Octobr October anno 38 Hen: 8 38th year of Henry VIII's reign, i.e. 1547 created and founded 3 free Grammar Schools in York shire one in York one in Hemsworth & one in Old Malton to be & continue for ever 3 several free corporations & if the Schoolmrs Schoolmasters of the said Schools might forever have a competent subsistence endowed the said Schools with certain Lands rents messuages a dwelling house with outbuildings and land and cottages

Particularly he gave & granted to the Schoolmr of Old Malton & his successors for ever as their(?) own proper inheritance certaine lands & tenements &c: as follows Imp: One Grange called Sutton Grange in the parish of Norton near Malton containing one house & other cottages one Garth, one Orchard, one Close on the north pt of the sd house 4(?) oxgang the amount of land tillable by one ox in a ploughing season - about 15 acres of land in the lordship of Sutton & one oxgang in ye Co of Norton now in possession of Francis Brampton of yearly valued rent to ye tennant twentie four pound of reserved rent to the Schoolmr three pound.

Item Some parcells of Lands called Broomhills wh the adjacent medows in the lordship of Ryton now in the possession of Ja. Galloway & Francis Cherston William Harrington of yearly extended rent thirty four pound ten shillings of reserve: rent six pound

Item one messuage one Cottage & five oxgang of arable land wh their ptinents pertinents - smaller buildings or items connected with the land in Ebberston in York shire now in the possession of Geo: Harrington trustee for Jo & Charles Cartwrights of yearly extend: rent 14 lib £14 - lib is an abbreviation for libra, pound 10s of reserve: rent fourty shillings Some lands here lost in Mr Cartwrights timeJames Cartwright, Master 1669-1697

Item The Rectory of Yeddingham in Yorkshire wh the pertinents of tithes of corn & other grain five oxgang of land lying below the fields of Yeddingham ye half of the tithes of corn & other Grain of West Heslerton & the patronage of the Church of Yeddingham now in the possession of Eliz: Galloway or her assnsgs of yearly extend: rent eighteen pound reserv: rent three pounds

Tho the Schoolmr ought to receive yearly out of the said lands five pounds, three pound out of Yeddingham & fourty shill: out of West Heslerton as is evident from a deed of gift of the Archbp of the said lands to the School of Old Malton which deed the present Schoolmr hath now in his custody which is the only evidence he hath for ye lands belonging to ye said school.

One house called the Schoolhouse one cottage beside the church yard gate one cottage opposite to garden(?) difficult to decipher this word, it looks like d a r t e n & the Churchyard (excepting the liberty of burying the dead due to the parish of Old Malton now in the possession of Geo Mill Schoolmr of the sd School [from 1697-1707]

There was likewise certain lands belonging to the said school in Hugate Huggate as appears from an inventory of evidences belonging to the said school & put in the cathedral of York by the first schoolmr to be kept & preserved there among the evidences of the cathedral which lands are now lost

Out of all the forsd aforesaid lands the present Schoolmr has but 14 lib of reserved rent – In the ancient constitutions by the founder he is appointed to receive out of them yearly 20 pounds over & above all charges & represes & four pound yearly for an usher the Schoolmr was likewise appointed by the founder to pay to the Organist of Malton 4 lib & 2 lib to the organist of Old Malton yearly but it is probable as some think he retracted that in his own time which power he reserved to himself in the Constitutions But if he did not reverse it the present Schoolmr wants 16lib yearly 6lib of his own rent 4lib for an usher & six for ye Organists

The founder annexed to the constitutions a schedule whereby, the Schoolmr was to be directed out of what Lands he was to receive his reserve: rent & how much out of each of them which schedule cannot now be found which occasions that the schoolmr cannot come to the knowledge of all the lands belonging formerly to the sd school nor of the reserved rents he was yearly to take out of them.

The present Schoolmr hath a copy of the constitutions Mr Hunter of Old Malton hath the constitutions wh Archbp Holgate’s subscription but whout without the Schedul the constitutions wh the Schedule were appointed by the founder to be forever in my Ld Archbp of York his register & a fourth to be in the cathedral Church of York which Schedule if it cannot be found neither in the Archbp’s register nor in the Cathedral nor above at London both School & schoolmr will be at a great loss if some other remedy be not found.

The Ld. Archbp appointed the schoolmrs of the sd school to let the ?? lands in lease to tennants for the space of 12 years only to have a seal for that end & to receive fines at this time a fine could be a sum paid at the start of a tenancy to reduce the rent, or as a fee & gross sums(?) at the renewale of each lease which money & Grassoms [to here] he appointed to be bestowed & imployed for the necessary suits defenses & causes of the above said lands & tenements & for costs & charges of them yt that labor for the execution of this foundation & re the reparation of the schoolhouses & for all the necessary maintenance of the ?? school of Old Malton. Yet notwhstandg notwithstanding that the Late Schoolmr I think this is a reference to James Cartwright, master from 1634 - 1669 knew that these fines & gross sums ought ? to be he had one lease left him by his predecessor Mr Galloway Mr Galloway preceded Mr Cartwright who was master 1669 - 1693, and who George Mill succeeded to a ??? entry & that he never as is well known made one step to receive these lands or rents which were lost & that he got school & schoolhouses in good repair & left them in a very ruinous condition: he let 2 leases yt week he dyedthe week he died one to his 2 sons & the rest of them to a tennant whose fines he left to his daughter his executrix who by her factors promised to repair so far as should be requisite if good wether offered & so kept of the present Schoolmr I assume this is George Mill from suing for repairs & now refuses to do anything.
